These terms govern your use of FleetFixer (the "Platform"), operated by FleetFixer in the United Kingdom. By creating an account or using the Platform, you agree to these terms and our Privacy Policy.
About the Platform
FleetFixer is an online marketplace connecting fleet operators, logistics businesses, and other vehicle owners ("Clients") with independent mechanics and workshops ("Mechanics") for commercial vehicle repair, maintenance, recovery, and related services. We provide software to post jobs, receive quotes, message, and organise work. We are not a garage and do not carry out repairs ourselves.
Who may use the Platform
You must be at least 18 years old and have authority to enter binding contracts (for yourself or the business you represent). The Platform is intended primarily for users in the United Kingdom. If you use the Platform as a consumer (an individual acting for purposes outside your trade, business, craft, or profession), additional rights under the Consumer Rights Act 2015 and related UK law may apply to services you purchase from Mechanics; those rights are between you and the Mechanic, not with us.
Accounts and security
You must provide accurate registration information and keep your login details secure. Tell us promptly if you suspect unauthorised access. You are responsible for activity under your account unless you have told us and we have had a reasonable opportunity to act.
Posting jobs (Clients)
Clients must provide honest, accurate descriptions of the vehicle, fault, location, timing, and access requirements so Mechanics can quote fairly. You must have authority to request work on the vehicle and to provide site access. Misleading posts, duplicate spam listings, or attempts to circumvent safety rules may result in suspension.
Mechanic responsibilities
Mechanics are independent service providers, not employees, agents, or partners of FleetFixer. You are responsible for:
- Quality and safety of your work, parts, and advice.
- Your qualifications, licences, and compliance with UK trade and vehicle standards.
- Appropriate insurance (for example public liability and, where relevant, motor trade cover).
- Your own tax, VAT, and invoicing obligations with Clients.
- Quotes and pricing you submit through the Platform unless otherwise agreed in writing with a Client.
Contract between Client and Mechanic
When a Client accepts a Mechanic's bid (or otherwise agrees to hire), a direct contract is formed between them for the repair or related service. Payment terms, warranties, cancellations, and complaints about the work itself are matters for those parties unless we expressly state otherwise. FleetFixer is not a party to that contract and does not guarantee outcomes, prices, or timings.
Fees and payments
Use of the Platform may be free during early access. We may introduce platform fees, subscriptions, or paid features in future; we will give reasonable notice before they apply to you. Unless we provide an in-platform payment service, payment for repair work is arranged directly between Client and Mechanic. We are not responsible for non-payment, chargebacks, or tax treatment of those payments.
Acceptable use
You must use the Platform lawfully and respectfully. You must not harass, discriminate, threaten, defraud, spam, scrape, reverse engineer, or attempt to bypass the Platform to harm other users. You must comply with UK law, including road safety and data protection rules when sharing locations or vehicle identifiers.
Our role and disclaimers
We facilitate introductions and provide tools. We do not vet every Mechanic beyond features we offer (such as optional verification). We do not warrant that any user is suitable, insured, or available. Reviews and ratings are user-generated opinions, not our endorsement.
Disputes
Disputes about repair quality, payment, or conduct should first be raised between Client and Mechanic. You may use our Disputes tool to notify us so we can review platform abuse or moderate accounts. Our involvement is discretionary and does not make us liable for the underlying repair contract. Nothing in these terms limits statutory rights consumers have against traders who supply services.
Intellectual property
We own or license the Platform, branding, and software. You retain rights in content you upload but grant us a non-exclusive licence to host, display, and use it to operate the Platform. You must not use our trademarks without permission.
Suspension and termination
We may suspend or close accounts that breach these terms or pose a risk to users or the Platform. You may stop using the Platform at any time. Provisions that by nature should survive (including liability limits where permitted) will continue after termination.
Limitation of liability
Nothing in these terms excludes or limits liability that cannot be excluded under UK law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Subject to that, FleetFixer is not liable for loss or damage arising from services performed between users, vehicle downtime, or reliance on user-generated content. We are not liable for indirect or consequential loss (including loss of profit, business, or data) except where such loss cannot be excluded by law.
If you use the Platform in the course of a business, our total aggregate liability to you for any claim relating to the Platform in any 12-month period is limited to the greater of (a) fees you paid us for Platform use in that period, or (b) £100. If you are a consumer, this cap does not apply to claims where it would be unfair under the Consumer Rights Act 2015.
The Platform is provided "as is". We do not guarantee uninterrupted or error-free operation.
Governing law and jurisdiction
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over disputes relating to these terms or the Platform, except that consumers resident in Scotland or Northern Ireland may also bring proceedings in their home jurisdiction where UK law allows.
Changes to these terms
We may update these terms from time to time. We will post the new version on this page and update the "Last updated" date. For material changes we will take reasonable steps to notify you. Continued use after the effective date constitutes acceptance where the law permits. If you do not agree, you should stop using the Platform and close your account.
